eleanortalk provides personalized emotional-support audio sessions for people moving through grief and the loss of someone they love. Each session is a digital product: a warm, reflective audio recording created from the details, memories, and feelings you choose to share with us, prepared for your situation and delivered to you electronically.

The session is intended as something gentle to return to — a private space for personal reflection and comfort. It is not a generic recording, and it is not a live service or appointment.

To use the Service or place an order, you must be at least 18 years of age and able to form a legally binding contract. By using the Service, you confirm that you meet these requirements. If you are using the Service on behalf of someone else, you confirm that you have the authority to do so.

eleanortalk is intended for personal reflection and emotional-support purposes only. It is not, and is not a substitute for, professional care.

• The Service is not medical, psychological, psychiatric, counseling, or crisis care, and it does not create a clinician–patient or therapist–client relationship.
• Nothing we provide should be relied upon as professional advice, diagnosis, or treatment of any kind.
• If you are experiencing a crisis, or you may be at risk of harming yourself or others, please contact a licensed professional or your local emergency services right away.

We make no promises about any particular outcome, result, or feeling, and we make no supernatural claims of any kind. The Service is a comfort and reflection aid — a companion alongside, never a replacement for, professional support.

Prices for the Service are displayed in US Dollars (USD) and are payable as a one-time payment for each session ordered. By placing an order, you authorize us to charge the applicable amount.

Payments are processed securely by our payment provider, Stripe. We do not store your full card details. The charge will appear on your statement under the descriptor ELEANORTALK. Your order is confirmed once payment has been successfully completed.

The Service is a digital product delivered by email as a downloadable audio file. After your payment is confirmed and we have received the details required to prepare your session, your session is typically delivered within 24–72 hours.

No physical goods are produced or shipped. Please make sure the email address you provide is correct and able to receive our messages, and check your spam or junk folder if your session does not appear.

Refunds and cancellations are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Please review it before placing an order, as it explains your options given that the Service is a personalized digital product.

To create your session, you may choose to share information, memories, and photos ("Customer Content"). You confirm that you have the right to share everything you submit, and you must not submit other people's personal data without the authority to do so.

You retain ownership of your Customer Content. By submitting it, you grant KROMA AGENCY LLC a limited, non-exclusive license to use those details solely to create and deliver your session and to provide related support. We handle Customer Content in accordance with our Privacy Policy.

When using the Service, you agree not to:

• use the Service for any unlawful, abusive, infringing, fraudulent, or harmful purpose;
• submit content that you do not have the right to share, or that violates the rights of others;
• resell, redistribute, or commercially exploit the Service or any session delivered to you;
• attempt to disrupt, interfere with, or gain unauthorized access to the Service or its systems.

The Service, the contents of eleanortalk.com, and the eleanortalk brand, name, and related materials are owned by KROMA AGENCY LLC or its licensors and are protected by applicable intellectual property laws.

The session delivered to you is licensed to you for your personal, non-commercial use. You may keep and listen to it as often as you like, but you may not resell, publish, or otherwise distribute it.

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your expectations or be uninterrupted or error-free.

To the maximum extent permitted by law, the aggregate liability of KROMA AGENCY LLC arising out of or relating to the Service or these Terms is limited to the amount you paid for the session giving rise to the claim. To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or anticipated benefit.

You agree to indemnify and hold harmless KROMA AGENCY LLC and its officers, employees, and contractors from and against any claims, damages, losses, liabilities, and reasonable expenses arising out of your misuse of the Service, your Customer Content, or your breach of these Terms.

Your information is handled in accordance with our Privacy Policy, which explains what we collect, how we use it, and the choices available to you. By using the Service, you acknowledge that you have read the Privacy Policy.

We may update or modify the Service and these Terms from time to time, for example to reflect changes in how the Service operates or in applicable law. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the jurisdiction in which KROMA AGENCY LLC is established, without regard to its conflict-of-laws rules. You agree that any such dispute will be resolved in that jurisdiction.

It also includes any free-text you submit and any optional photographs you choose to upload. You decide how much to share, and you are never required to provide more than you are comfortable with.

(b) Payment information. Payments are processed by Stripe, Inc. We do not store your full card details on our systems. Stripe’s handling of your information is governed by its own privacy policy, available at stripe.com/privacy.

(c) Information collected automatically. When you visit the site we may automatically collect your IP address, browser and device information, the pages you visit, and similar data through cookies and comparable technologies.

(d) Communications. When you contact us by email or otherwise, we keep a record of the messages you send and our correspondence with you.

We use the information we collect to:

• Create, produce and deliver your personalized emotional-support audio session;
• Process your payments and help prevent fraud;
• Communicate with you about your order, including confirmations and support;
• Send you marketing emails about the Service, which you can opt out of at any time;
• Operate, maintain and improve the Service;
• Comply with our legal obligations and enforce our terms.

Your information is stored in our email and customer-management systems and with trusted third-party hosting and storage providers. The audio sessions we create and the details you submit are retained for as long as needed to deliver your session, provide support, and meet our legal and accounting obligations.

You may request that we delete the information we hold about you. See Section 08, Your Rights and Choices, for how to make such a request.

We do not sell your personal information. We share information only in the following limited circumstances:

• With service providers and processors who help us operate the Service, including Stripe (payments), Klaviyo (email and CRM), Google (email and workspace), and our hosting, storage and analytics providers;
• With legal, regulatory or law-enforcement authorities where we are required to do so by law or to protect our rights;
• In connection with a merger, acquisition, financing or other business transfer, in which case your information may be transferred as part of that transaction.

We use cookies, pixels and similar technologies to operate the site, remember your preferences, and analyze how the site is used so we can improve it. You can control or disable cookies through your browser settings, though some parts of the Service may not function properly if you do.

We want you to feel cared for at every step. Each session is created with attention and respect, and your satisfaction matters to us. The sections below set out clearly when you can cancel, when you're entitled to a refund, and how to request one.

Each eleanortalk session is a personalized, made-to-order digital product — an emotional-support audio recording created specifically for you, around the details you choose to share. It is not a stock item; it is produced individually once your order is placed.

Because the product is both custom and digital, please read this policy carefully before ordering, so you understand how cancellations and refunds apply to a personalized item made just for you.

If you change your mind, you can cancel for a full refund as long as you contact us before we have begun producing your session.

To cancel, email contact@eleanortalk.com as soon as possible after ordering. If work on your session has not yet started, we will cancel the order and refund you in full.

We aim to deliver your session within the stated delivery window — typically 24–72 hours. If you have not received your session within that window and we are unable to deliver it to you, you are entitled to a full refund.

If your delivery is delayed, please check your spam or junk folder first, then contact us at contact@eleanortalk.com so we can resend it or arrange a refund.

If there is a genuine problem with your session, please contact us within 14 days of delivery. Genuine problems include, for example:

• The wrong details were used in your session.
• The audio file is corrupted, incomplete, or won't play.
• The session does not match what you ordered.

We will first offer to correct or remake your session at no extra cost. Where we are unable to resolve the issue, we will provide a refund.

Because this product is personal and subjective, how it lands can differ from person to person. We consider goodwill refund requests in good faith, on a case-by-case basis.

If your session simply didn't feel right for you, please reach out at contact@eleanortalk.com and tell us what happened. We'll listen and do our best to make it fair.

To request a refund, email contact@eleanortalk.com from the email address you used to place your order, and include:

• Your name.
• Your order details (for example, your order number or the date of purchase).
• A short note about what went wrong, if anything.

We may ask a few questions to help us understand the situation and find the best resolution for you.

Approved refunds are returned to your original payment method. Refunds are normally processed within 5–10 business days, though the exact timing depends on your bank or card provider.

If you have not seen your refund after this period, please contact us and we'll help you follow up.

If you have a problem with your order, please contact us first at contact@eleanortalk.com. We can almost always resolve issues faster and more easily by working with you directly than through a payment dispute.

Opening a chargeback before contacting us can delay a resolution that we would usually be glad to provide straight away.
