Terms of Service

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. We do not knowingly collect information from or provide services to anyone under 18.

The Service provides personalized audio readings delivered under the name "Eleanor Blackwell." All readings, vision portraits, and related content offered through the Service are provided strictly FOR ENTERTAINMENT PURPOSES ONLY.

• a Readings are not a substitute for professional advice of any kind, including but not limited to medical, psychological, psychiatric, financial, legal, business, or relationship advice.
• b No claims, representations, or guarantees are made regarding the accuracy, truthfulness, predictive value, or supernatural validity of any content delivered through the Service.
• c Any decision you make based on the content of a reading is made at your sole discretion and risk.
• d The Service is not therapy, counseling, or a mental health service. If you are experiencing grief, depression, suicidal thoughts, or any mental health crisis, you should consult a licensed professional. In the United States, you may contact the 988 Suicide and Crisis Lifeline.

We currently offer:

• a Base Reading: a personalized audio reading, priced between $34 and $44 USD depending on promotion or version.
• b Vision Portrait: an optional add-on audio reading priced at $67 USD.

Prices are displayed at checkout and are subject to change at our discretion. All prices are in U.S. dollars.

Readings are produced based on information you provide at checkout and through follow-up communications, which may include names, dates, relationships, photographs, and personal context. You are responsible for the accuracy of the information you submit.

Delivery occurs asynchronously, typically within several hours and up to 72 hours after we have received sufficient intake information. Delivery times are estimates and not guarantees.

We reserve the right to refuse, cancel, or refund any order at our sole discretion, including without limitation orders involving insufficient information, abusive behavior, or content we deem inappropriate.

You may request a refund after delivery of your reading by contacting contact@eleanortalk.com. Approved refunds are processed within five (5) to ten (10) business days from the date of approval.

Refunds may be denied where, in our sole discretion, the request appears to be abusive, fraudulent, or part of a pattern of repeat purchases followed by refund requests.

Chargebacks initiated without first contacting us in good faith are considered abusive. Customers who initiate fraudulent or abusive chargebacks may be permanently banned from the Service, blacklisted from future purchases, and pursued for recovery of the chargeback amount plus associated fees.

All content delivered through the Service, including audio recordings, written transcripts, and visual material, is the exclusive property of KROMA AGENCY LLC.

Upon purchase, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and listen to your reading for your own private, personal use only.

You may not:

• a reproduce, copy, or distribute the audio or any portion of it;
• b publish, post, broadcast, or share the audio publicly, including on social media, podcasts, YouTube, or any other platform;
• c resell, license, sublicense, or commercially exploit the audio in any form;
• d create derivative works based on the audio;
• e use the audio for any commercial, promotional, or training purpose, including the training of artificial intelligence models.

Any unauthorized use immediately terminates your license and may give rise to legal action.

You agree not to:

• a submit false, misleading, or fraudulent information;
• b harass, threaten, abuse, or send offensive or violent communications to us or to Eleanor Blackwell or any associated representatives;
• c attempt to gain unauthorized access to the Service or its systems;
• d use the Service to violate any applicable law or regulation.

We reserve the right to refuse service, terminate accounts, ban customers, and refuse future purchases from anyone who engages in abusive, harassing, threatening, or otherwise unacceptable conduct, with no obligation to issue a refund where conduct violates these Terms.

You agree to indemnify, defend, and hold harmless KROMA AGENCY LLC and its members, managers, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content or information you submit to us.

These Terms and any dispute arising out of or relating to them or to the Service shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.

Please read this section carefully. It affects your legal rights.

• a Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, whether in contract, tort, statute, or otherwise, shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small-claims court if your claims qualify.
• b Location and Procedure. Arbitration shall take place in Sheridan County, Wyoming, or, at your option, by telephone or video conference. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
• c Class Action Waiver. YOU AND KROMA AGENCY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
• d Opt-Out. You may opt out of this arbitration agreement by sending written notice to contact@eleanortalk.com within thirty (30) days of first accepting these Terms. The notice must include your full name, address, and a clear statement that you wish to opt out of arbitration.
• e Severability. If the class action waiver is found unenforceable, then the entirety of this Section 12 shall be null and void, but the remainder of these Terms shall remain in full force and effect.

We may modify these Terms at any time by posting the updated version on eleanortalk.com and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree, your sole remedy is to stop using the Service.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including without limitation breach of these Terms.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and KROMA AGENCY LLC regarding the Service and supersede all prior agreements and understandings.
